Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mail AI website (https://mailai.in), including its smart inbox dashboard, AI agent drafting, and WhatsApp/Telegram alert services (collectively, the "Platform" or "Services").

By registering for an account, accessing, or using the Platform, you ("User", "you", or "your") agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, you may not use the Services. We reserve the right to modify these Terms at any time, and continued use of the Platform constitutes your acceptance of such changes.

1. Account Registration & Security

• You must provide accurate, complete, and updated information during registration.
• You are solely responsible for safeguarding your login credentials, including third-party OAuth logins (like Google Sign-In). Mail AI is not liable for any loss or damage arising from unauthorized access to your account.
• You may not use the Services if you are under the age of 18 or barred from receiving services under applicable laws.

2. AI Agent & Human-In-The-Loop (HITL) Disclaimer

Mail AI utilizes artificial intelligence to summarize emails and generate draft responses. By using these features, you acknowledge and agree that:

• No Autonomous Sending: Mail AI is a Human-In-The-Loop system. The AI provides suggestions and drafts. It will not send emails on your behalf autonomously.
• User Responsibility: You are solely responsible for reviewing, editing, and verifying the accuracy of any AI-generated text before clicking "Send." Mail AI explicitly disclaims any liability for errors, hallucinations, incorrect pricing, or inappropriate content generated by the AI and subsequently sent by you to your clients.

3. Third-Party Integrations & SMTP Usage

• Custom SMTP: If you connect your own email provider (e.g., Gmail, Google Workspace, Outlook, Brevo) to send replies via Mail AI, you must comply with their respective Terms of Service and sending limits. Mail AI is not responsible if your email provider restricts, suspends, or bans your account due to bounced emails or usage violations.
• Messaging Platforms (WhatsApp/Telegram): Your use of WhatsApp or Telegram alerts must comply with Meta's WhatsApp Business Policy and Telegram's Terms of Service. Mail AI is not liable if your alerts are delayed or if your connected chat accounts are suspended by the respective networks.
• Google API Services: Mail AI s use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

4. Acceptable Use Policy (AUP)

You agree NOT to use the Platform to:

• Send unsolicited bulk emails (Spam), phishing attempts, or malware.
• Transmit content that is unlawful, defamatory, harassing, abusive, fraudulent, or infringes on any intellectual property rights.
• Reverse engineer, decompile, or attempt to extract the source code or AI prompts of the Platform.
• Exceed typical, reasonable usage parameters (e.g., attempting to use the 1-to-1 ticketing system for bulk marketing blasts). We reserve the right to throttle or suspend accounts that place an unreasonable load on our infrastructure.

5. Subscriptions, Credits, and Billing

• Free Trials: Mail AI may offer a Pro Trial (e.g., 7 days) and complimentary messaging credits. Once the trial expires, you must upgrade to a paid plan to retain premium features.
• Credits: WhatsApp and Telegram alerts consume credits based on the rates specified on our pricing page. Credits are non-refundable.
• Payments: All fees are exclusive of taxes unless stated otherwise. We reserve the right to modify pricing with prior notice. Subscription fees are billed in advance and are non-refundable.

6. Intellectual Property

All rights, title, and interest in and to the Platform (excluding User Content and third-party APIs), including its design, code, logos, and AI orchestration logic, are and will remain the exclusive property of Mail AI.

7. Limitation of Liability & Indemnification

• "As Is" Basis: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including warranties of merchantability or fitness for a particular purpose.
• Limitation: To the maximum extent permitted by law, Mail AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from your use of the Platform.
• Indemnity: You agree to indemnify and hold harmless Mail AI, its founders, and employees from any claims, damages, or legal fees arising from your violation of these Terms, your misuse of the Services, or your violation of third-party rights.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Greater Noida, Uttar Pradesh, India.
